1 The general terms and conditions apply to all agreements relating to online orders between Pasticcere and the customer.
2 Pasticcere will provide product information (and associated pricing information) on the website. Statements on the website regarding products and prices are non-binding and serve only as an invitation to make an offer.
2.1 The customer can order the products offered by Pasticcere on the website. The agreement is concluded when Pasticcere confirms the customer's order. Confirmation takes place through sending a confirmation email from Pasticcere.
2.3 The customer can cancel the order no later than one working day prior to the delivery date.
3 The customer is obligated to pay the price stated in the confirmation email for products ordered through the website, unless there are obvious typographical errors. Obvious inaccuracies in the confirmation email can be corrected by Pasticcere even after the email has been sent.
3.1 Prices are in euros, including VAT. Prices listed on the website and in advertisements are subject to change without notice. Special offers are valid only while supplies last and for the specified period.
3.2 Payment is made in advance via iDeal, Credit Card, Goggle Pay and Apple Pay.
4 Communication between Pasticcere and the customer takes place electronically, unless otherwise provided in the general terms and conditions and/or the agreement. The version of the relevant communication stored by Pasticcere serves as proof thereof, unless the customer provides proof to the contrary. Electronic communication is deemed received on the day and time of sending, unless the recipient proves otherwise. If the communication is not received or received too late due to delivery and/or accessibility issues related to the customer's mailbox, this is at the customer's own risk.
5 Pasticcere provides the customer with the general terms and conditions prior to concluding the agreement. The customer is responsible for saving and printing the general terms and conditions if needed before ordering online from Pasticcere.
6 Pasticcere strives to ensure the information on its website is as accurate, complete, and clear as possible. However, products may vary slightly from the images shown on the website.
7 Pasticcere is never liable for any indirect damage to the customer or third parties (including consequential damage, lost turnover and profit, loss of data, and immaterial damage) related to or arising from the agreement or the use or consumption of the products. Without prejudice to anything else in the agreement, Pasticcere's liability to the customer, for any reason whatsoever, per event (whereby a related series of events is considered a single event) is limited to the purchase price of the product in question.
8 Pasticcere is not liable for the malfunctioning or inadequate functioning of the website, the telecommunications infrastructure and/or other communication errors or any possible consequences thereof.
9 The customer must cooperate with any recall initiated by Pasticcere, even if the customer has provided the products to third parties. Any resulting damages will be reimbursed up to the purchase price of the recalled products.
10 The general terms and conditions and the agreement are governed by Dutch law. All disputes arising from or related to an agreement must be submitted to the competent court in Amsterdam.
11 Own design
11.1 The client agrees that the assessment and decision to approve or reject an image and/or text rests with Pasticcere. Pasticcere will not correspond with the client regarding the reason for rejection.
11.2 The customer undertakes not to supply any images and/or texts that are contrary to the law, morality or public order or that have a religious content.
11.3 The use of an image and/or text chosen by the customer is always at the customer's own risk. Pasticcere is not liable for this. The customer accepts that the final image on the pastry may differ in color and image quality from the image and/or text submitted by the customer.
12 Deliveries are made Monday through Friday between 9:00 AM and 5:00 PM. There are no deliveries on Sundays and public holidays.
Pasticcere reserves the right to deviate from the above delivery times. If the client requests the contractor to deliver the order at a specific time, the contractor will consider this time as a target time. The contractor is not obliged to deliver at the preferred time.
In the event of delays and/or calamities, Pasticcere will contact you on working days.
13 Orders are delivered to reception and to customers' front doors. Pasticcere is not responsible for internal deliveries.
If the order cannot be delivered to the delivery address due to absence of recipient or closure or refusal of the company, this is at the risk of the customer/client. The contractor will attempt to deliver the order to a nearby address and inform the customer/client about this, the client is not obliged to do so.
If it is not possible to deliver to a nearby address, the order will be taken back and stored in a cool place. We will contact the customer to discuss the options for a subsequent delivery. The costs associated with the subsequent delivery will be charged to the customer/client. (This does not apply to deliveries on Saturdays and deliveries that fall before a public holiday; these cannot be delivered later.)
14 When purchasing products, consumers have the right to cancel the agreement without giving reasons within seven business days. This period begins on the day after the consumer receives the product.
14.1 If the consumer exercises his right of withdrawal, he will be responsible for at most the costs of return.
14.2 The Contractor excludes the consumer's right of withdrawal to the extent provided for in paragraph 1. The exclusion of the right of withdrawal only applies if the entrepreneur has clearly stated this in the offer, at least in good time before the conclusion of the agreement.
15 Exclusion of the right of withdrawal applies to products:
15.1 that can spoil or become outdated quickly.
15.2 which have been created by the contractor in accordance with the consumer's specifications;
15.3 that are clearly personal in nature;
15.4 which by their nature cannot be returned;
